As provided in the California Food and
Agricultural Code (CFAC) Chapter 10, division 17 under 46016.1 and
the California Organic Standards Act of 2003 (COSA)-110940 (a), the
Organic Consumers Association is hereby filing a formal complaint
to the Director the California Department of Food and Agriculture
State Organic Program (SOP) and California Department of Health Services,
in regards to the labeling practices of Avalon Natural Products.
I. Abstract:
The basis of this complaint resides
in the evidence, given below, that Avalon is falsely labeling a large
number of their products as “organic” in violation of regulations
set forth by the National Organic Program (NOP) and the California
State Organic Program (SOP).
II. Avalon products in violation

III. This complaint is based on violations
of the following regulations:
Under
COSA 110811 This article shall be interpreted in conjunction with
Chapter 10 (commencing with Section 46000) of Division 17 of the Food
and Agricultural Code and the regulations promulgated by the National
Organic Program (NOP) (Section 6517 of the federal Organic Foods Production
Act (OFPA) of 1990 (7 U.S.C. Sec.
6501 et seq.)).

(a) All organic product regulations and any amendments to those
regulations adopted pursuant to the NOP, that are in effect on the
date this bill is enacted or that are adopted after that date shall
be the organic product regulations of this state.

46024(c) It is unlawful for any person to mislabel any organic product.
IV.
Violation #1: Hydrosol/ Floral Water
Organic
cosmetics can only be labeled “Organic” if they are made up of at
least 70% organic ingredients, not including water:
COSA
110838. (a) Cosmetic products
sold, labeled, or represented as organic or made with organic ingredients
shall contain, at least 70 percent organically produced ingredients. (b) The percentage of all organically produced
ingredients in an agricultural product sold, labeled, or represented
as "organic" or "100 percent organic," or sold,
labeled, or represented as being made with organic ingredients or
food groups, or as inclusive of organic ingredients, shall be calculated
as follows: (1) For products containing organically produced
ingredients in solid form, by dividing the total net weight of combined
organic ingredients at formulation, excluding water and salt, by the
total weight of the finished product, excluding water and salt. (2) For products containing organically produced
ingredients in liquid form, by dividing the fluid volume of all organic
ingredients, excluding water and salt, by the fluid volume of the
finished product, excluding water and salt.
If the liquid product is identified on the principal display
panel or information panel as being reconstituted from concentrates,
the calculation should be made on the basis of single-strength concentrations
of the ingredients and finished product.
The
Avalon products listed in section II.(1) of this document are in violation
of this regulation, as the main “organic” ingredient in these products
is “Organic Hydrosol”/”Floral Water”. Hydrosol is simply an elaborately
made tea made up of 99.9% water with only trace levels of organic
plant material. As the COSA regulation clearly states above, the only
portion of hydrosol that should be figured into the final organic
volume of the product is that part that is not water. This is further
reiterated in the NOP regulations, which the CA SOP reflects.
If
hydrosol were to be considered an organic ingredient, soup and beverage
companies could all quickly and easily begin labeling their products
as “Organic” simply by converting the added water to organic hydrosol.
If California allows
hydrosol to be considered an organic ingredient, it sets a precedent
on a national level that could ultimately render the Organic Standards
Act useless.
V.
Violation #2: Use of Synthetic
Surfactants and Preservatives
Because CA SOP regulations state that
organic cosmetics labeling in California
must follow the same criteria as NOP (COSA 110811 and 110956 (a) ---see section IV of this complaint
for full text) the following regulation is violated with the use
of synthetic surfactants (namely, olefin sulfonate, cocamidopropyl
betaine and methyl/propylparaben):

and handling. To be sold or labeled as "100 percent organic," "organic,"
or "made with organic

ingredients or food group(s))," the product must be produced
and handled
without
the use of:

substances and ingredients, except as provided in § 205.601 or § 205.603;

Surfacant Violation (1): Olefin Sulfonate

All of the
Avalon products listed in section II.(1) of this document contain
olefin sulfonate, which is made either by “cracking” long hydrocarbons
from petroleum, or polymerizing ethylene oxide, also from petroleum,
and turning it into this chemical compound. It is a synthetic petroleum
surfactant that is not allowed in products labeled organic pursuant
to the NOP. Avalon claims the products currently on store shelves,
containing olefin sulfonate, were manufactured over a year ago. The
use of olefin sulfonate in Avalon products that are currently being
manufactured needs to be investigated.

Avalon products listed in section II.(1) of this document contain
cocamidopropyl betaine, which is
also a synthetic surfactant built in part from petroleum that
is not allowed in NOP or CA SOP regulations (NOP- OFPA 205.105).
Synthetic Preservative: Methyl/propylparaben

The following Avalon products violate
the CA SOP organic standards with the use of the synthetic preservative
methyl/propylparaben: All Avalon products listed in section II (1)
and (2) of this document.
VI. Violation #3: Lack of Certifying
Agent in Labeling
As CA SOP and NOP state, if a product
is to be labeled organic, the certifying agent’s information MUST
be included on the information panel of the product’s packaging. In
checking various co-ops and natural food stores, none of the Avalon
products contain this information. The specific regulation in violation
follows:

organic by...," or similar phrase, identify the name of the certifying

VII.
Violation #4: Mislabeling
As
stated in the CA SOP (see below), cosmetics can only be labeled “organic”
if they contain a minimum of 70% organic ingredients. If it is less
than that, the only place a cosmetic product can advertise itself
as organic is on the ingredient and information panels of the packaging.
The following Avalon products are in violation of this regulation:

& Shower Gel (dominantly labeled “56% Organic” on front label)
- Organic Clarifying Conditioner
(dominantly labeled “56% Organic”)
- Organic Hand and Body Lotion
(dominantly labeled “62% Organic”)

110839. Multi-ingredient cosmetic
products sold as organic in California with less than 70 percent organically
produced ingredients, by weight or by fluid volume, excluding water
and salt, may only identify the organic content as follows: (a) By identifying each organically produced
ingredient in the ingredient statement with the word "organic"
or with an asterisk or other reference mark that is defined below
the ingredient statement to indicate the ingredient is organically
produced. (b) If the organically
produced ingredients are identified in the ingredient statement, by
displaying the product's percentage of organic contents on the information
panel.
VIII. Close
Under COSA 110940 (b), we look forward
to the Director’s outline of procedures for commencing an investigation
within seven working days and to the investigation outcome and enforcement
actions within 90 working days following that.
