Canada bans pesticide, faces
lawsuit under NAFTA

US chemical company seeking 100 million in damages

In case you missed it, there is a new NAFTA investor-state
claim against Canada.

Crompton Corp. a US-based chemical company (formerly UniRoyal
Chemical Company Inc.) is suing the Government of Canada, alleging
that the phase-out of the pesticide lindane used to treat seeds (canola) is
"tantamount to expropriation" and that Canada has violated national treatment,
minimum standards of treatment and the performance requirements provisions
of NAFTA'S chapter 11. Crompton is seeking damages of 100 million.
